c) Comments by Patrick Bonck, Thomas Genin and Janet Butterworth in favor of the issuance of a conditional use permit.
d) Rebuttal by Julie Gaspard.
After full discussion, the Board adopted an ORDER denying the appeal filed by Nancy Garziano, Jill Larrousini, Joni Jensen, Julie Gaspard, Timothy Norton, Tina & Steven Penton and Harlan King and confirming the Planning Commission's decision to approve Case File 2312HC214 for a Conditional Use Permit by Patrick Bonck for Thomas Genin and Janet Butterworth requesting a Conditional Use Permit to allow for a 6-lot single-family residential subdivision on a 2.099-acre parcel of land as shown on site plan with the following conditions: (a) hire a third party arborist to review the trees on the property, and (b) ensure an HOA is in place prior to issuing any building permits. The R-1 (Low Density Residential) District requires a conditional use permit for residential subdivisions. The subject property is located at 120 Bayview Street. The ad valorem tax parcel numbers are 0213G-03-033.000, 0213G-03-033.001, 0213G-03-034.000 & 0213G-03-034.001.
