A hearing was held at 10:00 a.m. to consider the appeal on Case File 2503HC046 for Tax Parcel Nos. 0309F-01-010.000 and 0309F-01-009.001, and received the following comments:
a) Introduction by Eric Nolan, Zoning Administrator.
b) Comments by Bobby Heinrich, in favor of a Zoning Map Amendment and Conditional Use Permit.
c) Comments by Rhonda Halterlien, Gerry Gathof, Darryl Hughes, Adrienne March, Sherice Anderson, Sam Sketteno, Cynthia Drouilhet, Laura Anderson, Rusty Necaise, and Ann Johnson, opposed to a Zoning Map Amendment and Conditional Use Permit.
d) Rebuttal by Bobby Heinrich.
After full discussion, the Board made a motion to adopt an ORDER granting the appeal filed in opposition by Rhonda Halterlien to Case File No. 2503HC046, and thereby reversing the decision of the Planning Commission to grant a Zoning Map Amendment and Conditional Use Permit to Heinrich & Associates, LLC on behalf of Russell Bang, seeking to rezone two (2) parcels of land totaling 32.77 acres. The properties are currently zoned as A-1 (General Agriculture) District. The request is to change the zoning district classifications to the R-1 (Low-Density Residential) District for the purpose of developing a 23-lot, Type III single-family residential subdivision as shown on the site plan. Residential subdivisions require a conditional use permit from Planning Commission. The subject property is located at XXXXX E. Dubuisson Rd. The ad valorem tax parcel numbers are 0309F-01-010.000 and 0309F-01-009.001.
