The Board held a hearing at 10:00 a.m. on Case File 2604HC097 and received the following comments:

After a full discussion the Board adopted an ORDER upholding the appeal as filed by Ausby E. Johns and overturning the Planning Commission's decision of for a Conditional Use Permit filed by Kyle Lindley (Intent Holdings, LLC) for MS REIP, LLC requesting a Conditional Use Permit to allow for a medical cannabis dispensary and processing facility on a 2.0-acre parcel of land as shown on the site plan. The C-2 (General Commercial) District requires a Conditional Use Permit from the Planning Commission for a medical cannabis dispensary and processing facility. The subject property is located at 8027 Menge Ave. The ad valorem tax parcel number is 0310 -25-011.002.
